A note on our experience in obtaining PRC anti-monopoly clearance

We have been assisting several of our clients on projects requiring prior clearance from the PRC MOFCOM Anti-Monopoly Bureau (中華人民共和國商務部反壟斷局) (the “AMB“). Just recently, we successfully helped to secure for a client the AMB's clearance which was needed for its acquisition project to proceed. We advised on the legal requirements, pre-filing meeting with the AMB officials, information and analysis to be included in the official application and submission to the AMB, obtaining independent industry expert's opinion, responses to enquiries from the AMB during its investigation, supplemental submissions, etc. We have now developed a sound understanding of the requirements of the AMB in its review and investigation of an application for its clearance, which we believe is important and helpful towards assisting our clients in obtaining clearance from the AMB where necessary, for the smooth implementation of their projects.
