Joseph, a Solicitor Advocate, advises employers, contractors and consultants on a wide range of construction related disputes. He also advises clients on multi-national commercial disputes in litigation, arbitration and mediation. Highlights include the following:

Construction

• advising the employer in its dispute with one of its consultants regarding the construction of the Tsing Ma Bridge
• acting for the employer in relation to a number of developments affected by the “short piling” incident. The employer was entirely successful. This was widely reported in the press in 1998
• acting for a sub-contractor in its claim against the main contractor in relation to one of the main building services contract in the airport core project. This was a complex arbitration involving disputes on quantity of work done and claims for extensions of time
• acting for the main contractor in its dispute with its formwork sub-contractor regarding the construction of the Tiu Keng Leng MTR station
• acting for the employer in its dispute with its piling contractor regarding defective piling work carried out for a major development in Fanling
• acting for a well-known fire services contractor in relation to its dispute with its principal contractor regarding the fire services installation for the DHL Central Asia Hub at the Hong Kong International Airport
• advising the main contractor in relation to the construction of a major commercial complex in Shanghai. This construction dispute involved issues on PRC arbitration and negotiation of supplemental agreement
• acting for the employer in an arbitration with its main contractor regarding the construction of a footbridge for a major development in Olympic Station
• acting for the employer in an arbitration with its main contractor regarding a major development in Lai Chi Kok
• representing a major architect firm in defending a professional negligence suit lodged by the developer. The architect was entirely successful and obtained an indemnity costs order against the developer
• acting for the developer in an arbitration with the main contractor regarding a major residential development in Tung Chung
• acting for the owner of a mine in Mongolia in respect of its dispute with its contractor for mining works
• advising a contractor in an arbitration against the employer in respect of a development project in Macau. The dispute has been widely reported in the press.
• advising contractor on Express Rail Link project
• representing one of the contractors in the high profile Commission of Inquiry into Excess Lead found in Drinking Water in public housing estates. Given the public interests involved, this 67-day inquiry was widely reported in the press on a daily basis
• advising on a multi-party dispute involving the construction of a major casino in Macau
• advising LPG supplier in relation to underwater LPG pipeline works in South China Sea
• advising contractor in relation to dispute arising out of the construction of the Hong Kong Zhuhai-Macau Bridge
• advising contractor in relation to dispute arising out of the construction of the Heung Yuen Wai Control Point
• Joseph also has experience in advising on energy and resources related disputes
• Apart from advising on construction disputes, Joseph also advises on contract/tender preparations including partnering arrangements and NEC
• Joseph speaks regularly at seminars on construction related topics
• Joseph is the co-author of “Bullen and Leake and Jacob’s Hong Kong Precedents of Pleadings” and co-author of “The International Arbitration Review” (Fourth Edition)
• Joseph is also the co-author of the Hong Kong version of one of the leading UK construction textbooks “Emden’s Construction Law in Hong Kong”

International Arbitration / Litigation

• acting in a major commercial litigation concerning the merger and acquisition of a well known construction company in Hong Kong which was one of the parties to the Ting Kau Bridge Joint Venture
• advised the developer on a high profile dispute regarding a development project in Mei Foo Sun Chuen. The dispute had been widely reported in the press due to wide spread protest by the Mei Foo residents and involvement of political parties. Joseph was quoted in newspapers and weekly magazines on a number of occasions. The case was also reported in law reports – Billion Star Development Limited v Wong Tak Chuen & Ors [2012] 2 HKLRD 85 and Re Ho Mei Ling [2012] 6 HKC 1
• advised a hotel group in arbitrations in multi-jurisdictions on development of hotel chains in Mainland China with over HK$490 million at stake. Arbitrations were conducted in HKIAC and CIETAC
• advising a French fire engine supplier in a litigation against a public authority with over HK$100 million at stake
• advising film producer in an arbitration with over HK$100 million at stake
• advising a major supplier of LED display in an arbitration with over US$50 million at stake
• acting for a purchaser of a mine in Mongolia over a dispute on a mining license with dispute to be resolved by SCC arbitration
• acting for a mine owner in respect of enforcement proceedings of a CIETAC award in Hong Kong
• acting for Receivers in relation to enforcement of a SIAC award in Hong Kong with over HK$300 million at stake
• acting for insurance company in respect of enforcement of ICC arbitration award in Hong Kong

Apart from party representation in arbitrations, Joseph also sits as arbitrator in Hong Kong and overseas.
