Genevieve has extensive experience in handling cross-border multi-jurisdictional dispute resolution including complex commercial arbitration and litigation.

Highlights

Cross-border related disputes include:-

• acting for a bank to claim over EUR100 million against another bank subject to sanctions in HKIAC administered arbitration and High Court proceedings
• acting for a Japan-based technology company in enforcing US judgment of over US$27 million in Hong Kong
• acting for a Taiwanese high net worth individual concerning a family business dispute related to one of the world’s largest expanded polystyrene manufacturers in various High Court actions including contempt proceedings
• acting for the former directors of a HK listed company in the cement industry and the shareholder of the holding company to defend various trust actions, appointment of receivers, contempt proceedings, injunction proceedings, unfair prejudice petitions, fiduciary theft, misappropriation of company’s assets and breach of fiduciaries duties
• acting for a Mainland Chinese company in recovering earnest money of over HK$450 million in the acquisition of shares of a HK listed company in High Court
• acting for a Church regarding a dispute over the beneficial ownership and exclusive possession of a landed property in High Court
• acted for the BVI company vendor and Mainland Chinese guarantor in the acquisition of shares of a HK listed company in HK seated arbitration and Mareva injunction proceedings in High Court to defend claims of over RMB400 million
• acted for an international electronics manufacturer headquartered in Mainland China to claim against its Middle East distributor for over US$3 million in a HKIAC administered arbitration
• acted for a company owned by a Mainland Chinese individual in recovering deposit paid after termination of MOU relating to possible acquisition of shares of a HK listed company in High Court
• acted for various Taiwanese companies and individuals in a complex shareholders dispute with a Singaporean company arising out of agreements for sale and purchase of shares relating to high value resorts in Mainland China in various HKIAC administered arbitrations and High Court actions
• acted for a Chinese Bank in recovering debt of over HK$300 million against a guarantor in bankruptcy proceedings
• acted for a Japanese semi-conductor trading company to claim against its insurer for the sum of over US$5 million in respect of credit risk insurance policies in a HKIAC administered arbitration
• acted for a Chinese Bank in recovering debt of over RMB20 million against the guarantor including the enforcement of arbitral award in HK
• acted for the trustee in bankruptcy to set aside various undervalue transactions
• acted for a duty free retailer in contractual dispute against the brand owners and shopping mall owners
